What does the Constitution say?

17 March, 2025
A great many posts are arguing about what Trump has been doing and it is Constitutional or not. I had not read the Constitution since Civics class in grade school, many years ago. I pulledConstitution it up on line and looked at what the powers of each branch of the government are and how the founding fathers instituted a strong set of checks and balances in response to what they had endured under the English Monarchy. It was very interesting.
Article I defines the Congress and Sections 8, 9, and 10 define the role and powers of Congress. I am not a lawyer but in my interactions with them regarding business contracts I came away with an understanding that in a contract the provisions that come first have precedence over the provisions that come later in the document if there is any dispute. By putting the definition of Congress and its powers in the first Article, they indicated that this branch would have precedence in any dispute of who has the authority between the three branches. They also provided an extensive list of those powers totaling 875 words.
Article II defines the Presidency. Sections 2 and 3 define the role and powers of the Presidency in 322 words, less than half of the words used to define the powers of Congress. And 108 of those words define powers that are "with the advice and consent of the Senate". Only 214 words define powers specific to the Presidency.
Article III defines the Supreme Court. Sections 2 and 3 define the role and powers of the Supreme Court in 304 words. Interestingly, in three different places it specifically calls out Congress having the power in this set of definitions for the Supreme Court.
I strongly encourage you to read the definition of the three branches of the government and what the roles and powers of each are. These three Articles are only 10 pages long in total, so a very quick read. Here is a link to the document - https://constitutioncenter.org/the-constitution/full-text.
It is very clear that this country was founded on the basis of checks and balances and the most power was given to the branch that had to get a majority of members to agree on the answer. In the name of efficiency Donald Trump is attempting to usurp many of the powers that the Constitution gives to the Congress. It is up to the other two branches of the government to respond and protect the checks and balances that have made this country great for 236 years.
What we as citizens need to do is to put in office in the 2026 and 2028 elections the people who are committed to keeping the principles defined in the Constitution intact.
